GIFT CARD TERMS AND CONDITIONS

These terms apply to the use of physical gift cards bearing The Body Shop brand ("Gift Cards"), digital codes intended for online redemption only ("Discount Code"), and gift cards sent by email ("E-Gift Cards"), collectively referred to as ("TBS Gift Cards").

By purchasing or using a TBS Gift Card, you accept and agree to these terms and conditions ("TBS Gift Card Terms").

We may amend these TBS Gift Card Terms from time to time. Any changes will take effect once the revised terms are published on the website. Please check this website regularly for any updates. Nothing in these TBS Gift Card Terms affects your legal rights.

When you use a TBS Gift Card, the amount of your purchase will be deducted from the Gift Card balance. You can use the TBS Gift Card as partial payment for goods worth more than the TBS Gift Card balance, subject to payment of the difference.

PHYSICAL GIFT CARD – FOR IN-STORE USE ONLY

Validly activated Gift Cards can be used as full or partial payment for products in The Body Shop branded stores in Italy only.

To check the balance of your Gift Card, simply bring it to one of our stores and ask a sales assistant to check the balance for you.

If you would like to convert your Gift Card into a Digital Gift Card in order to make purchases exclusively online, please contact Customer Care at customercare@thebodyshop.it, who can transfer the valid balance onto a Digital Code. See below for further information on Digital Codes.

DIGITAL GIFT CARD – ONLINE AND IN-STORE USE

Validly activated Gift Cards can be used as full or partial payment for products in The Body Shop stores in Italy and can also be used for online purchases at https://www.thebodyshop.it.

For in-store use, please print the E-Gift Card and bring the printed barcode, and our staff will be happy to assist you. For online purchases, the card number must be entered in the Gift Card payment section of our website.

SALE OF TBS GIFT CARDS

TBS Gift Cards can be purchased in-store at any point of sale, or online from our website https://www.thebodyshop.it.

The minimum amount required to purchase a TBS Gift Card is €25, up to a maximum limit of €200 per individual TBS Gift Card.

Payments for online purchases can be made by VISA or MasterCard debit or credit card. Payment by TBS Gift Card is not accepted.

Payment is charged at the time the TBS Gift Card is purchased. Actual receipt of payment is required before orders are shipped.

Every transaction is subject to various anti-fraud checks, and Cosmetica Etica S.r.l. (together with third-party service providers) reserves the right to refuse an order if payment is subject to further verification or checks, or for any other reason, without providing an explanation.

Gift Cards ordered through online sales will be sent to the email address specified in the individual order. Delivery will normally be immediate, but may take up to 48 hours from receipt of payment.

Where possible, Cosmetica Etica S.r.l. (and third-party service providers) will try to fulfil all delivery requests, but will not be liable for any loss suffered, whether directly or indirectly, as a result of failure to meet the requested delivery date. In this context, "loss" means any loss of profit, costs, damages, charges, other expenses, consequential losses, and non-financial losses.

Risk transfers to the customer upon delivery, and title passes upon receipt of payment in full. Cosmetica Etica S.r.l. has no liability for TBS Gift Cards that are lost, stolen or damaged once risk has passed to the customer upon delivery.

Except as required by law, no refunds will be given on the purchase of a TBS Gift Card. Once payment has been received, an order may only be cancelled by writing to Customer Care at: customercare@thebodyshop.it.

The collection and handling of credit card data and personal information is used solely to authorise payment and is not stored by Cosmetica Etica S.r.l. for any other purpose. Cosmetica Etica S.r.l. reserves the right to share transaction information with any law enforcement body, if required. For the purposes of these terms and conditions, the Privacy Notice available on the thebodyshop.it website applies.

Quantities of TBS Gift Cards (number of TBS Gift Cards ordered and value loaded onto each) must be checked immediately upon receipt. Any discrepancies must be reported immediately to Customer Care at: customercare@thebodyshop.it. Except as required by law, Cosmetica Etica S.r.l. cannot be held liable for any shortages or losses of TBS Gift Cards not reported within 3 working days of delivery, or of the delivery date specified for lost cards.

Cosmetica Etica S.r.l. shall not be held liable for failure to fulfil its service obligations where such failure is caused by events beyond its reasonable control, such as: acts of God/force majeure, industrial disputes, government intervention, fire, flood, and disruption to computer and IT infrastructure.

Although the content of the cards website is checked for accuracy, Cosmetica Etica S.r.l. shall not be held liable for omissions or errors, or for any statements contained on the site. Cosmetica Etica S.r.l. is not responsible for any losses suffered as a result of using information from the website, or if access to the site should cause viruses to computer equipment.

USE OF TBS GIFT CARDS

All TBS Gift Cards expire, and any unused funds will be forfeited if not used for purchases within 18 months of activation. You will not receive any reminder when your TBS Gift Card is about to expire, and it is your sole responsibility to ensure that the balance is used in full before it expires.

Funds on TBS Gift Cards cannot be converted into cash or any other means of payment at any time. No change will be given, but the remaining balance will stay on the TBS Gift Card to be applied to future purchases. TBS Gift Cards cannot be exchanged for a different currency or for another type of TBS Gift Card.

All refunds for goods or services purchased with a TBS Gift Card will be made in accordance with the refund policy on the thebodyshop.it website. Refunds for products purchased with a TBS Gift Card will be credited back onto a TBS Gift Card.

Subject to applicable law, we reserve the right to cancel any TBS Gift Card and/or suspend or permanently discontinue the entire TBS Gift Card programme, or any part of it (including online redemption), where we consider such action to be legally necessary. Such action may be necessary, for example, to comply with applicable laws or regulations, where there is reasonable evidence of tampering or fraud, or as a result of circumstances beyond our reasonable control. We reserve the right to correct the balance of a TBS Gift Card where a material or accounting error has occurred, even if payment for the TBS Gift Card is disputed or has not been received.

We cannot replace a TBS Gift Card if it is lost or stolen. Please treat your TBS Gift Card with the same care you would give to cash. Cards will not be replaced if lost, stolen or damaged. TBS Gift Cards do not constitute a cheque guarantee, credit card or debit card.

We reserve the right to refuse to accept a TBS Gift Card as payment where there is reasonable evidence of tampering or fraud, or if the TBS Gift Card is mutilated, altered, damaged or deteriorated in any way.

For the avoidance of doubt, TBS Gift Cards cannot be used for purchases or redeemed through third-party sellers of The Body Shop branded products.

For the avoidance of doubt, we only accept TBS Gift Cards: we do not accept other gift cards, including All For One, Amazon, or other commercial gift cards.

GENERAL PROVISIONS

Breach of the TBS Gift Card Terms by you will entitle Cosmetica Etica S.r.l. to seek any appropriate legal remedies available, whether by way of injunction, damages, or otherwise.

These TBS Gift Card Terms shall be governed by and construed in accordance with the laws in force in Italy. Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Court of Milan.
