Love Your Body Club Terms and Conditions

Welcome to the Love Your Body™ Club ("LYBC") loyalty programme, operated by Cosmetica Etica S.r.l. for The Body Shop brand and valid within Italian territory (the "programme"). Please read these terms and conditions carefully. By signing up for and taking part in the programme, you agree to be bound by the terms set out below.

Membership

●       All programme members must be resident in Italy and be 18 years of age or older.

●       A valid email address is required to sign up for the programme. It is your responsibility to keep Cosmetica Etica S.r.l. updated if your email address changes. We cannot be held responsible for any loss of points or Rewards (as defined below in clause 3(1)) resulting from out-of-date details.

●       Each Member is entitled to only one programme account. Cosmetica Etica S.r.l. reserves the right to refuse, merge or close additional accounts at any time.

●       Your membership is for personal use only, and we may, at our sole discretion, refuse any request or revoke a membership and/or cancel or reduce points at any time where we believe your transactions to be excessive and/or intended for commercial or non-domestic purposes, or subject to resale or further shipment.

●       The LYBC programme, the account, the Rewards and the points, however expressed, are issued by and remain the property of Cosmetica Etica S.r.l..

●       The LYBC programme, the account, the Rewards and the points are valid solely for use on the thebodyshop.it e-commerce website.

Use

●       You can earn points and redeem your Rewards when you make purchases on the thebodyshop.it e-commerce website, excluding third-party partners.

●       Points and Rewards have no monetary value and cannot be converted into cash.

●       You must be signed in to your account when you wish to earn points or redeem your Rewards.

●       From time to time, we may ask you to verify your identity to ensure that the account is not being used fraudulently or otherwise in breach of these terms and conditions, and to verify the identity of the person using the account.

●       Programme accounts, points and Rewards may not be transferred, purchased, sold or traded in any way.

●       LYBC Rewards are your responsibility. Cosmetica Etica S.r.l. cannot be held liable for any loss resulting from a member's failure to keep such items safe.

●       You can check your points and Rewards on your profile on the thebodyshop.it e-commerce website.

Points and Rewards

●       For every €1 spent online in a transaction using your account, you will earn 5 loyalty points. For every 500 points accumulated, your account will automatically be credited with a voucher worth €5 (a "Reward").

●       Points will be credited to your account within 7 days of being earned.

●       A maximum of ten (10) Rewards may be active on an account at any given time. Where an account already holds ten Rewards (the maximum) and a new Reward is generated as a result of reaching 500 accumulated points, the oldest Reward on the account will automatically be removed.

●       The maximum total number of points that can be earned in a single day is 5,000 points, and each account has a maximum limit of 3 transactions per day on which points can be earned.

●       Unless otherwise stated, points are earned on all purchases except gift cards, delivery charges and plastic or paper bags.

●       Points will be earned on the price paid for items after any discounts or vouchers have been applied at checkout.

●       Standard Rewards will expire after 3 months if not used.

●       Points will be deducted from your balance for any transaction relating to products that are returned or refunded.

●       Each Reward may be used only once, for partial or full payment of products. Any remaining value of a partially used Reward will not be refunded.

●       Rewards may be used in combination with other promotions, offers or discounts, unless otherwise specified.

●       Photocopied or illegible paper Rewards will not be accepted.

●       Birthday Reward – if you have provided us with your date of birth, are signed up to receive marketing emails, and have made a purchase or placed an online order using your LYBC account within the 12 months preceding your birthday, you will receive a Reward worth €5 during your birthday month. Birthday Rewards are valid only during the birthday month, and in any case for no more than 30 days from the date of issue.

●       Points earned will be credited once the order has been fulfilled by our warehouse and shipped. This may take a few days during busier periods.

Termination and Expiry

Cosmetica Etica S.r.l. reserves the right to discontinue your participation in the programme: (a) if you have not used your account (to earn points or redeem Rewards) for a period of 12 months; (b) if it believes that use of your account is unauthorised, fraudulent or otherwise unlawful; (c) for any conduct relating to the programme that involves theft, misconduct, offensive or abusive behaviour, or the provision of false or misleading information; or (d) for any breach of these terms and conditions.

You may end your participation in the programme at any time by emailing Customer Care at customercare@thebodyshop.it.

Following termination or expiry of your account, all points and Rewards already accumulated or issued will be cancelled.

Amendment and Termination

The programme's terms and conditions, member benefits, FAQs or any other description of the programme are subject to change at any time.

Cosmetica Etica S.r.l. also reserves the right to terminate, discontinue or cancel the programme at any time and at its sole discretion. Any amendment, change or termination of any part of the programme or its terms will take effect immediately upon publication of such changes on the thebodyshop.it e-commerce website.

Your continued participation in the programme will confirm your acceptance of such amendments or changes; you should therefore review these terms and conditions and any applicable policies frequently in order to understand the terms and conditions that apply to the programme. If you do not accept the amended terms, you must stop taking part in the programme.

Personal Information and Marketing

We will use your personal information to manage your programme membership, for sales and marketing analysis, and to personalise your marketing experience (where appropriate). To find out more about how we use your personal information, please refer to our Privacy Notice.

If you have consented to receive marketing communications from us, we will contact you from time to time to send you marketing communications and keep you updated on our products, promotions and special offers, as well as general information about The Body Shop brand. You can unsubscribe from receiving such marketing communications at any time by clicking the "unsubscribe" link in any marketing email from us, by logging into your online account, or by writing to privacy@thebodyshop.it.

If you have not consented to receive marketing from us, we will contact you only with service information relating to your account.

General Provisions

These terms and conditions shall be governed by and construed in accordance with the laws in force in Italy. Any dispute or claim arising out of or in connection with these terms (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the Court of Milan.
